You have no issues with the testing station as you have no contract with them!
please dont talk shit, you have a collateral contract with them, i.e. you are third party to the contract between the MOT and dealers, so yes there is a contract
err that is bulls*it mate, what if the cat passed the emissions whilst at the mot station, and then deteriorated soon after? hardly mot testers fault is it??

Basically yes. They are both liable.
For example i run a garage but dont do mots, tyres or paint.
If I had a car come in for MoT i would send it to a 3rd party then do any work needed then send it back for retest. Should it need a tyre i would put it into the tyre place i use.
The customer obviously would only pay me.
No supposing it failed on one tyre and i did nothing at all too it.
If the wheel subsequently fell of it because the tyre fitter hadnt torqued it up correctly, obvioulsy the tyre place would be liable but also so would I.
The same goes for if something was missed on the mot test it wouldnt just be the testers fault but mine also!

tbh mate it is prob a case of the guy knows the mot tester and you know the rest, which is bit off on your part, but you can guarentee the garage well try and wriggle out if it, however you dont get if you dont ask
