My friend bought a new car a wee while ago and guy said it was all hpi clear etc then he found out yesterday while he was at the garage getting a new exhaust etc that the car was a cat c car so he came home and done a hpi check and was on there as a cat c but repaired by a bodyshop
Is there anything legally he can do?
Dont think there is is there seeing as he should of hpi'd it himself before getting it

should of hpi it before purchase he will have signed a sold as seen recipt which means cant get anywhere

i did second hand car sales for a while and basically u sign you have no comeback unless stated on the letter/form you sign said hpi checked before sale if not no possible come back

should have asked to see the hpi report? as i assume its something u get a copy of?

they should have prooved they hpi checked it first if the company does guarentee there hpi cleared he would need no evidence he would be in the right all the way

Yeah didnt think there was anything he could do but just wanted to check before he tries to take it any further with the guy!

yea best to check all facts first as it will just kick off otherwise car sales is just not good

It was private sale not a dealership. Think if it was dealership there might of been something he could of done but didnt think so with private. Silly boy that he is lol!

no chance, private sales are sold as seen. It is all down to the buying to check hpi prior to buying it!

Traders can't lie but there's far less protection offered to buyers from private sales.

I would be asking for a refund or at least some cash adjustment based on a fair alternate valuation.

I'm also sure you can try small claims court etc. It might also be considered to be obtaining money by deceit, which is of course a criminal offence, have a search about see if there any similar documented cases which have been successful.
