I Recently sold my megane 225 trophy as it was costing too much to run . I Bought the car from a garage in august 2011 and sold it in may 2012. I never received a logbook from the garage and when i questioned them they said to contact dvla but due to other priority issues at the time i forgot all about it . So when it came to selling i didnt have a logbook but both me and the new keeper both gave each other a reciept for the sale and he said he would apply for a log book . I came home today to a nice letter informing me of - SEIZURE NOTICE SECTION 165 A ROAD TRAFFIC ACT 1988 VEHICLE DRIVEN WITHOUT LICENCE AND INSURANCE .

The above vehicle has been seized by police , the vehicle has been removed to and being kept ( AT OWNERS EXPENSE " Who on paper is me" ) at premises .........

Im under the impression the vehicle has since been sold on.

Am i Liable for any fines, storage fees etc ?

Im now in a better financial state and wouldnt mind it, so am i entitled to have the car back lol ?

cheers

If you have proof of sale, no, they can't charge you for it.

I had this once on a car i sold,
phoned the police force where it was siezed, but i was to honest and had said that it wasnt mine anymore (logbook had been sent but new owners handwriting was unreadable, so i doubt DVLA could read it)
he then said no problems, will cut the ties to me, asked him if i could get it back the same way though by paying the fees etc, his answer was i could have but i'd just told him it wasnt mine anymore.

unsure if his answer was to wind me up though?!

Won't it get crushed if its not recovered by the current owner within 10days??

Good luck to them if thats the case. Can't see them getting the appropriate documents within that short time scale.

14 days in Strathclyde. Is it in the 911 yard at Jessie St?
After 14 days it will be authorised for disposal and the registered keeper would receive what was left of the amount it sold for after the recovery & storage charges.
It's £150 plus £20 a day in fees.

I very much doubt the car will still be sitting in storage now. If it was my car, I'd be straight down the day after ( or as soon as possible ) to get it back.

I wouldnt wait on the letter as that I just a formality.

Also to claim the car back he would need to prove Insurance and rd tax mot for said vehicle would he not as the reason it was seized was no insurance etc

Thats the thing, if the OP is getting the letter, then the person who has had the car seized won't be the registered keeper. So can't just stroll in with the correct paperwork and get it back. As he won't have the V5 for the car to prove its his.

If the car is still reg'd to the OP, then he will get a letter to say some1 else has applied for the V5. But seeing as he hasn't heard anything from the DVLA, the current owner clearly hasn't applied for the V5 yet.

Can see this getting disposed of like what Gez has said.

How do the dvla have the car registered to you but you don't have the log book?
It's obviously registered to you as you have the letter

Dont sweat it bro. I sold my Civic a couple months ago then i got a letter from the police saying it was involved in a hit and run :L Then some guys insurance sent me a letter saying i owed 1200 quid in damages as it was involved in an accident. Anyways i just showed the recipt we wrote each other (i had a log book but couldnt find it at the time) and they didnt hassle me again after that. Turns out the guy i sold it to was a serious addict and enjoyed getting buzzed of tabs..... BEaring in mind he looked like an average guy i didnt know the difference

Nik, that's what's meant to happen.

I blagged a mate of a mates M5 rep out on day15 using my traders policy - but as it had been authorised for disposal it was a pita, had to say the boy owed me the £ etc and I woulda lost out had this happened.
Ended up keeping it anyway so all good!
