It wasnt contrary to anything - it wasnt a public highway and the only people that could have you done is Kwik Save.

an as im aware they have no problem with us using ther car park.

Its not their porogative then - if you crash into someones car in a car park you dont have to give them any details whatsoever - because its private property and off the public highway. Your insurance does not by law cover private property.

Doesn't matter that its private property!
They can still do ya!
The only way they can't impound your car is if its on your property when they try to impound it as they have to have a warrant to get the car!
Unless a car specific complaint was recieved and the police caught you doing something wrong (not just parked up) then the european law of human rights should get ya off as its illegal to ban someone from a public place without reason!

read the law again, kwik save car park may b privately owned but i do belive it has easy access by the public which in the law it states if a car park is easily accessed by the public then it is part of the public high way

so all the laws which stand on the high way still stand on kwik save car park, stupid but true

Ok, this maybe the case - but the case about the insurance stands - if you crash in a private carpark (for example) you dont have to give your information - even though its curteous and proper to do so.

I would like to see them inforce a point of view in court. The law as it standards is partly unenforcable due to point of view not being classed al legible evidence.

The bit which I refer to is regarding the fact that if they think you are going to do something which could cause distress to they can take your car, the fact is that in this case they have no way of proving intent. So you cannot actually be prsecuted, they cannot take your car.........they will try but if you took them to court the ruling would not stand.

thats what i keep saying - when them guys in dorset or wherever took it to court the cops were loosing so they dropped the charges and gave them their cars back - its a total farce - they just know that most of ultimately are law abiding citizens and that if the cops say give me your car and pay this fine that normally we just do and then they are happy - its only the little scummer bastard car theives who realis that it is hard as fook for the cops to PROVE anything if u have the bare face cheek to deny everything

i know what your saying but the difference here is if a car theif was seen nicking a car or driving 1 then he would be convicted for it,yes if your not seen doing it,it can be hard to prove, but in this case the police officer or even officers have seen him,and feel he's causing or going to cause a nusiance like i say they'd have to have sufficent evidence to back it up,like compliants from residents near by

Did you make a complaint to them?

Tiger- the only rule that doesnt apply when your on a car park is that you dont have to have tax and cant be done for not having it. All the rules such as insurance and dangerous driving apply!

I know a few cases where solicitors have said insurance on private property is down to the owners of said vehicles because they are not a public right of way.

3 of my friends have used this as a case with the law after various incidents.
