following the thread by someone on here the other day that had a letter through the post to attend court, I have done a bit of searching to find which section of the road traffic act the police in the North east is using to prosecute, at present over 40 people have been given fines and letters to attend court for no paticular reason othe than parking their car and not getting out of it, some had even bought a ticket and displayed it in their window, others had parked on a sunday in a car park that is free on that day and still had fines/court letters. below are the details:
YOU being the driver of a vehicle namely a ford registration number ....... did contravene the soth tynesdie metropolitan borough council (foreshore and off street parking places) consolidation order 1996 as amended mdae by south tyneside council under section 35(1) of the road traffic regulation act 1984 as to the use of a vehicle in a parking place situatead harbour north car park in that you did drive a vechicle into a parking place other than for the purpose of leaving that vechicle in a parking place in accordance with the provisions of the order or for the purposes of departing from the parking place contrary to section 35A(1) of the road traffic regulation act 1984 as amended.
so it is now against the law to park a car and not leave the area. even if you have bought a ticket

ive been given letters like that for being seen in a car park... (because anti social behaviour has happend on a few occasions.
i have a list of 5 car parks ive been seen in. (one is my work car park)

what if you park in the car park waiting to pick someone up from work/train station/shopping centre
what if i drive my mum to tesco's and wait in the car until she finishes and comes out?
what if i buy a mcdonalds/burker king/kfc and sit in the car park in my car eating it?
it makes no sense whatsoever and i think anyone who gets this should use examples like these to be honest as it's exactly the same thing.

you know, if a they tried that with me, i would be prepared to hire the best lawyer in the land to fight that one in court, its such a stupid bylaw i actually doubt the cps would bother defending it and wether the court would dissavow the case.

like shite im paying 75 quid for pulling my car in for 30 secs then leaving again
so by law when the driving instructor teachs people using the car park and he tells you to pull in the bay while he explains somthing hes breaking the law ?

its not discrimination really, if that was the case cops wouldnt be able to stop people that look shifty and on drugs etc
fact is majority of kids in modified cars in a carpark at nights won't be there to go shopping

correct steve, but you cant make a law and not enforce it for everyone.
For e.g People who are caught speeding in anything other than a vauxhall/ford/vw hatch get off scott free, but the rest get done?
A law is a law and should be obeyed 100% NO EXCEPTIONS
I see what you are saying, but tbh there are laws for searching etc whcih would be of more use than your not allowed to park in this car park

I agree if its only modded ones they are pulling tbh.
A bit of a shit law but the minority spoil it for the majority.
Exactly the same as people complaining about who is stopped in -insert religious argument here- cases.
Target the type of people who are causing the problem.
I have NEVER been stopped by the police in my car.

what time of day?
doesnt add up to me, people park in car parks all the time and wait for someone to pop into the shops or what ever - more to the story IMO.

its a car park looking onto the sea front
i was there for a jog, car park full of people in modified cars, my car was standard at the time and only 3 people got done me and 2 people a space up and the woman sitting with the 2 other cars got let off.
