Had a accident at work today and been advised to claim.
Basically there's huge plastic flaps going from the roof to the floor ( between factory floor and stores) and behind that was a metal chain going from wall to wall but I couldn't see it because of the flaps and there's no warning signs at all. Anyways I was in abit of a rush and went to walk straight through and tripped over. Tried putting both arms out straight to stop my self but right arm cracked. Turned out iv broken my elbow and another bit of bone has snapped. I'm in a temp cast until Monday to see if the bone will go back into place if not they said il need metal plates in. I'm now on the sick will be £80.
Do I have a case? How do u go about it?

Also the chain wasn't even tight it was slack so around shin height in the middle

on a serious note yes you most likely do have a case and id just get in touch with an injury claim place...
people on here will probably go on about how every one wants a claim nowaday blah blah

The chain is there to stop people walking in the stores ( was on opposite side of me behind the plastic flaps). Only allowed beyond that point with hi viz and hard hat which I had

It's worth a try. I'm now in a cast upto my bicep and my daughters due any day now il only get 80 a week sick pay. Surely there should be warning signs

if you attend hospital the incident needs to be reported to RIDDOR, did you fill the accident book in? you have a case as not everything that was practicable was done to ensure your safety.

CLaim for lost earnings only.
If you go for the full whack then your a bellend. Its 50/50. Chain shouldnt have been there etc and you shouldnt be running through curtians you cant see though.

Do it TBH, i did it when i got hit by a forklift and broke my leg. It went 50/50 but still got a decent amount out of it

Are you briefed on the hazards of crossing the physical barrier (plastic flaps) in an induction or anything? They will try to get out of it but you might as well try to get some cash if you'll be off work a while.

I'd disagree here, yes with false whiplash claims but this guys been injured just trying to carry out his job. If people didnt claim for industrial accidents then this country would not have the 1st class workplace HSE standards that it has & there would be more injuries....more deaths etc.

It's very rarely up only the 3rd time iv seen it up. Never had an induction no. Ringing around tomorrow
