not sure on insurance question but he'll be done for "driving otherwise than in accordance with a license"

but surely as it's invalid without a full license holder in the pass seat, surely then it counts as no insurance? Insurance wouldn't pay out if he had an accident as he hadn't complied with the conditions of being a provisional license holder

he'll still have a policy in place which is legal, if he's no driving within the terms of the policythen it's up to his insurers to void the policy but it isn't voided retrospectively and he was still in possesion of a valid insurance certificate at the time ofthe accident. If his insurers cancel the policy they still legal have to pay out as an rta insurer under article 75 (if he returns his certificate)
