To be honest I don't care either way. None of us wanted the accident. Like I said I would fix my own motor and forget about it . It's nothing like an old person judging by an exhaust, I can tell roughly what speed without any equipment and that's backed up by the damage to the landy . Am not trying to make audis life hard as long as the gent in the landrover gets taken care of .

is that because you feel guilty as if he didnt stop it just would of been you and the audi?

When I hit someone up the rear, who then bumped into someone else. The claim when through the insurers of the accident order, then they all claimed it back off me.

Me: Car 1.
Car I hit: Car 2
Car hit by car I hit: Car 3.

Car 3 claims of Car 2, who claims off me for themselves and the Car 3.

Claim off him and you'll have a non fault claim aganst you so isurance will go up

not having a go at you or anything. just don't want you to sound like a complete moron on the phone to the insurance company

I'm struggling to see how you'd lose if you weren't even moving.

I assume you weren't causing an obstruction?

Negligence would be driving too fast for the conditions. If you go skidding off and hit something, you're negligent. The snow didn't make the decision for him to attempt that road in that car.

Even if he was totally out of control and there's nothing he could have done to avoid, I'd be asking why he'd chosen that route if it would be clear to anyone in the same position that it was not possible to negotiate that route safely.

Surely be the same as when there is a pile up on a motorway ?

Audi caused it - own insurance
Audi hit disco - disco claims off Audi
Disco hit Transit - transit claims off disco

Yes, the man stopped to help, neither of us expected what happened, claiming off him is like slapping him in face after him trying to help me out. He even said if it drives he would carry on towing me.

Just renewed , past giving a shit with insurance they put it up this year and I haven't had a claim

Fair enough. Wouldn't claim off the landy guy though, well harsh. He may have invalidated his insurance by recoveeing you too

if theres a dispute yeah, disco insurer includes transits costs in their claim off the audi. if audi accepts liability everyone claims off him.

Yes, no need to involve landy guy. Like I say though the insurer has subregation rights so they can still dispute it based on snow. I'd be surprised if they did though if their client is openly accepting liability
