They've really muddled this up tbh. It's not new the legislation has been there since 1988. All that's changed is that there is now a bit on it in the Highway code. It is good that attention has been drawn to this as long as we use a common sense approach. Clearly it is different to using a mobile telephone where your hand is off the wheel, you are unable to change gear properly and on top of that you are concentrating on a conversation. I don't think there will be any ground breaking shifts in the Police approach as a result of this tbh.

bloody hell this is a bit much 
i very rarely smoke now (since the ban has been in place) but i never feel like im out of control of the car when i/if i do smoke.
IMO its just as bad as drinking a soft drink while driving, that takes 2 hands to open, what if it fizzes everywhere? you are going to have a reaction, what if you drop it with the top off? you are going to have a reaction. If you are a smoker then im sure you would have been able to come accustomed to holding a lit fag in your hand without dropping it every 2 mins.
Most people can also find their smokes, lighter and light up without even taking their eyes off the road, try doing that while changing CD/Radio station.

Easy. The controls on the stereo don't change or relocate. I can operate all the switches in my car without looking at them.
You're quite right though, I nearly crashed whilst changing a CD. Fucking 6 CD Changer, fancy putting it in the boot....

How many of you smokers keep your cigs on the steering coloum (sp) against the clocks.
Any how many of you have went to get your cigs (putting hand through the wheel) and then had to turn the car and got your bloody arm stuck ive witnessed my bro do this in a car park and i bet it's very common!

I kept mine in the door pocket, not in a stupid place.
I'd never light up on the move, always at a junction or something, never dropped a cigarette either because I don't have crippled hands.

aye, Well I managed to eat all of my lunch today whilst drivin (was maily stuck in traffic anyways)
but it's not the easiest of things - also people that roll the cigarettes in the car is pretty risky... there has been plenty of times when I've had to hold the steering wheel for mates!

you could have got done for driving without due care and attention for smoking while driving before this came into place. they've just highlighted the fact.
the point is that if you're doing anything that takes your attention away from the road, eating your drivethrough meal, picking your nose or trying to change radio station you can get done for it, and has been for a long time

It's like holding a mobile phone in your hand, then putting it to your ear for 1 second every 20, and not talking to anyone...
