Well i have been told after an uncle nob hed of mine got done for drink driving................that yes as said before you ask for a blood test as they have to get a doctor to come out to take it then............you do as many press-ups as posible in your cell while you wait and that sweats it out (just what my uncle nob head was told after he had been done for it lol)

If he was back under the legal limit then it would not have been taken futher, and also you can only be prosecuted from failing a blood test - not a breathaliser. Only thing I can think of is he's been arrested for failing to provide a sample.
So this doesnt make any sense??

I got caught sitting in my car just after drink driving 8 TIMES OVER (seriously couldnt stand up, totally paraletic) which would usually be a 3+ year ban but got away with it before it went to court because:
I claimed the witness(es) were old and tired (80+ old peoples home)
I told them I was so innocent it would cost the police force thousands in paying for my legal aid and court appeals
Basically, Kerry, there are so many defences for drink driving, and you should FIGHT IT TO THE END. And even once youve lost, take it to the court of appeal.
The blood test is interesting, but you should be aware that:
a) It takes time to prepare, you could sober up 'a bit' during this time
b) Once taken, you cant argue against it in court, its ACCURATE. Breath machines can be literally ripped to pieces in court, they have many KNOWN flaws and errors.
c) If the blood test will take more than 2 hours to prepare, you will still get a breath read out too.

Also, the limit is 35mg for breath and 80mg for blood
Your friend should be aware that:
a) If the breath test was below 50mg (yes still a lot over) the case will often get quashed either before or in court
b) If the blood is only 1 mg over (81mg) then they will still try and prosecute you, as theres no staturory defence against blood test procedure

Why on Earth were you drink driving 8 times over the limit?
You obviously weren't bothered about it and should have been jailed so you at least couldn't do it again for that period of time.

if your caught in the act though you will find it much harder to get found not guilty though its by no means impossible

I seem to think that being in possession of car keys and intent to enter your car whilst drunk can constitute drink driving, is this right? I was a bit worried as a few weeks ago whilst wasted i went to my car in town to collect my coat as we were getting the bus home and there were a few policemen about but i needed my coat as the bus was waiting an i had 2 run back to the busstop lol

my mate was 0.8 over whihc is aprently like a small gulp of beer, he got 12 months ban but cut down to 9 if he goes on a course.

it can constitute:
'drunk in charge of a vehicle'
this is with the keys and near the car or sleeping in the car, hence 'in charge'.
Although before anything can happen, they have to have reason to believe you had intent to drive whilst still under influence (which is difficult to prove as you fight it to the end, then appeal if lose etc)

Robbo - i am not condoning it, as a soon to be defence lawyer i will specialise in this and get many people off as there is a lot of money in it
it is wrong though and VERY dangerous, yes
no worse than driving while tired though or having taken painkillers.

PK, yes I work for the Crown.
Started there after I finished Uni, going to convert my degree when the next scholrship scheme starts I hope.
But been there for nearly 3 years, not a lot about criminal law or processes I don't know! Though thats my only knowledge of the law, your fortunate enough to of been eductued on all aspects!

Why not Robbo. If you can get yourself off of something then go for it. I could of gone not guilty for I went down for but was then facing 4-5 years if convicted. But in drink-driving youve got nothing to lose but your licence.
I'd fight it to the end.

Everybody would fight it joe, I know even if I had done wrong i'd most likely not want to go to jail for it etc.
This guy is talking about it like its ok, just drink and drive and do this and that to get off.
I wonder if that'll work when he hits somebody like mav, his wife and kid and kills them.
Doubt it.

I'm not defending him but I have drunk drive a lot in the past. But its taken 2 of my mates dying to stop me. Of all the people I know I'd say half drink drive all the time.
