well i do MOT services on trucks quite often! If it has a spare wheel then it has to be road legal! Oh and on the sheet it dont say spare wheel coz it comes under tyres therefore all tyres are checked if present! if no spare wheel then they only check whats there!

You're not legally required to carry a spare but if you do have one it must be legal. You must also not drive through the Mersey Tunnel without one. Not a lot of people know that

No it doesn't, the test covers the four (or however many) road wheels only, the spare does not come into the test and its condition is immaterial. You cannot fail a test on the condition of the spare.

I'd say by the amount of cars that don't come with a spare tyre as standard these days, you would'nt need one for an MOT.

Your right, you don't have to carry a spare legally. Also if you do carry a spare, regardless of its condition, it cannot lead to an Mot failure as the spare is not covered by the test regardless of whether its carried or not....
TYRES/WHEELS
Tyre condition
A failure with respect to tyre wear will result where:-
The grooves of the tread pattern are not at least 1.6mm throughout a continuous band comprising:
• Central 3/4 of the breadth of tread
• Entire outer circumference of the tyre.
Tyres must be correctly matched with regard to:
• Type
• Size
• Structure
• Location on the vehicle with respect to the axles.
Also examined:
• General condition of tyre
• Condition of valve
Tyres fail if they have serious cuts, bulges or other damage. The wear on the tyre is checked with a tyre tread depth gauge to ensure compliance. The tyres are examined to ensure that there is no fouling with any part of the vehicle.
Note:
The condition of the spare tyre is not part of the MOT.
