She has just started working for car phone warehouse, her contract says:
Basic salary : £8250 + commision
But if you do not make 1000 a month, they will make it up to it.
Eg.
If you get paid 950 in month one, we will make your money up to 1000, then in month 2 if you earn 1250 we will deduct 50 from it.
now she works 45hrs a week and is 20, 8250/52/45 is not minimum wage.
but say she never earns 1000, will she then owe the company money?
we cannot understand her contract, and neither does her manager, as he is new and on a different pay scheme.
Any ideas??

not sure on that mate i earn £11400 basic plus comission which is around £350 per month on average. but then i sell tvs not phones!

well she started earning commision 2day, and earnt 46 quid :O ontop of her money.
how i see it is, she earn 750ish basic, then doesnt earn any commison untill shes over 250 basically, but thats not minimum wage then

basically if she earns under 1k they make it up but will soon take it back when she goes over
dunno about the owing if you never earn 1k but then if they keep making it up each month and you never make it back it sounds dodgy to me
prob doing it to make sure she makes the effort to sell and earn the commission
i wouldnt like to be tied to a contract like that to be honest
best bet is speak to citizens advice!!

i meant they will be able to explain better and give advice not the fact it might not be legit
and anyway a contract is a contract its up to a person whether they sign it or not it doesnt necessarily mean it has to be fair
some contracts dont include sick pay or holiday pay but it doesnt make them not legit

Is the min wage for under 21yr olds not £4.25 / hr???
Phone the National Minimum Wage Helpline on 0845 6000 678 - ask them 
It sounds to me like they are giving you a step up to meet the min wage when you dont make it yourself through poor sales. Then claiming it back the following month off your comission. Bit of a con really!!!

I wouldn't be so sure, CPW is the dodgiest company I know. Just look at TalkTalk and all their scams.
Ring the NMW helpline like Colin says an report them.

just found out the starter pack she got given waso ut of date, and its all changed now. shes gonna find out exactly whats going on today

living on that sort of salary, she earnt 50 quid in the first day of commision, another guy there has taken home over 2k a month quite often. there commision rates are quite good

well all the time shes been there (1 month), nearly every1 comes to her for stuff, rather than any1 else. but she couldnt earn commision then, she can now, so we will see how it goes. she doesnt need to earn any more than 15k anyway to make us more than safe when we move out

my best mate works for vodafone doing sales in store. He only gets £950 basic but then gets commision. His store has joint commision which is all add up and split but then top seller gets more than rest. Also if theres one slacking loads then he/she doesn't get as much. Each month for the past few months hes been taking home £950 basic plus £800 commision - thats mainly because of xmas though. His usual commision is around £300-400

yes with talk talk i believe you dont get paid your commission until the customer actually signs up and if i remember rightly there is no wage until you do sell anything!!!

with talk talk, she gets the commision as soon as they sign up, which they do in the shop anyway. shes gets quite a high payment for them as well

I would probably think anything CPW add to her wage each month to take it to £1000 if she doesnt reach that figure herself when handing her notice in it will be taken off her final wage

if they do that cca, her basic wage doesnt meet NMW, but the contract was out of date, will find out when shes home

yes she may well do, but yarmouth has been the highest earning branch in EA, since it opened, she deals with more than half the customers, and theres 6 of them
