lost my simcard on the 3d of august in newquay!
phoned up as soon as i got home and they said they'd send another!
Received nothing after 2 weeks so I phoned up again.. this time I said id like to cancel my contract, they told me to send all the necessary details etc required to cancel..
I did as they asked and Since Ive been billed again, phoned them up, and they want to charge me for another simcard as They've already sent one out!
So il be billed for 3 months at £35 and ive not had use of the simcard!
any suggestions?

p.s the reason I say 3 months is as they aren't willing to cut off my contract until 3 months as thats how much notice they need!

How do they justify 3 months?

IIRC my mate gave his company £50 and they cancelled straight away.
Think that was with Vodafone though

you signed a contract, if you cancel within that you have to pay the remainder of what you are contracted to pay.
If you lost your sim how is that their fault? And why leave it 2 weeks to chase a lost sim?
Be more organised IMO

I signed the contract (AGREED)
But they also state that im given a free simcard If first one is lost...
They want me to pay x amount of pounds for the new simcard which will take 7 working days to arrive and a day to activate.. they're cutting my contract off on the 22nd of sept...
I see your point jambo
BUT... 2 months without usage!
The replacement was sent by standard mail with no tracking code!
surely something like that should have been sent recorded?

Not to a user it isnt!
They've just phoned back.. they're sending me another free of charge..
and the simcard's they send are already active!
So its hardly worth 0.000001p is it. as it can be used fool!

if they had stated theyd send 1st replacement free, it might be if it was faulty or stolen. Lost will be different, but if its mentioned that they cover lost then well they are badgers
All orange sims are sent recorded delivery

no network sends active sim cards in case they get stolen. if they send an active sim card in the post it is a breach of DPA

well i know for a fact that we are not allowed to send registered sim cards in the post-firstly the sim cards come from a warehouse so its physically impossible for us to register a sim card that we dont know the number of.
secondly-if we could somehow send them active and a dodgy postman swiped the sim card and used it for a week racking up a £500 bill-the onus is on the customer. wether or not the advisor got it wrong i dont know-would you be happy with a car manufacturer sending you an active key to your door?
my guess is you wouldnt

They obviously Know the number of the simcard as its a replacement!
I've been told it will be active when it arrives so we'll wait and see..
and about the postman swiping it....
"
why send a sim card recorded?? its worth 0.00001p?!"
