This is what im thinking Robin, its been nearly 6 months now since he drove it away, why wouldnt he of done it sooner?

The thing is my girlfriends panicking over it and its really getting to her if it wasnt for me she would of paid him by now. Anything I can "legally threaten" him with to write in a letter to get him to back off?

Id just ignore him.

The whole reason hes threatening you with court action is to scare you as robin said and by the sounds its working..just ignore it he will go away because it would just be laughed out of court.

Or just take some mates round and sort it the old fashioned way.

But serious mate...ignore him he will go away.

Just ignore it yeah!

It'll be easy to show that the car wasn't purchased through ebay,

He is bluffing, I'd maybe call him and bluff back.

Say you've spoken to a solicitor and you are well within your rights to have him done for harrassment,

may scare him into fcuking off and paying his own bill,

He has no come back. If it went to court, show the reciept and it would be case closed.

Eh?

If you buy a car from me, drive 2 miles down the road and the engine falls out, there is NOTHING to say that I have to offer a repair, private sales do not come with warranty.

The buyer is the one who needs to check the car over and make sure it's as described, not the seller, hence 'caveat emptor'

The only way you could possibly claim anything is if it was mis-described and you can prove it.

If both parties have signed a reciept, that's that, even if it wasn't as described, you signed acknowledging that it was in the state you bought it.

Thats it, I bought a car and the head gasket went on the way home, paid for it to be fixed and no more was mentioned, although I was pissed off I didnt try and make them pay for it!

Would him handing over the money and signing the logbook count? As I didnt get a reciept myself but I gave him one, which was signed by him and my girlfriend.

He's trying to scare you into paying for the repairs. He knows he has no leg to stand on or you would have recieved a solicitors letter.

The only way he could 'do' you is if the car was dangerous and not fit for purpose. Tell him where to go.

I wouldn't worry, why not give a solicitor a ring to put your mind at rest? Most offer free advice/first consultation, I think any decent place won't mind giving you 5 mins of their time for nowt.

What a freak!

When you buy a second hand car private you take a chance. If you want warranty then you go to the big garages and be prepared to spend a bit more cash.
