Recently bought This Netgear 24 port Switch only to find out these models are incredibly noisy which is not what im looking for.

The seller states on his auction no returns and he's confirmed on email that he wont let me return the item.

Do I;

1, relist the item on ebay (which is a PITA),
2, pick fault with his auction and start the resolution center?

with regard to #2, I dont have too many ideas, but he does state in his auction the switch comes with full netgear warranty, but the whole reason im buying a switch is partly because my old switch (also bought on ebay), doesnt come with a warranty due to the fact it wasnt purchased from one of their "approved resellers" and doesnt carry the original proof of purchase.

Do I be a cnut or relist?

Also, the thing that annoys me, I sent him two emails before he shipped the device and told him to hold off, he claims he's replied and made a sarky comment for me to "check my ebay messages", but he did not send a message, which is making me lean towards #2.

is he a business? if so distance selling rights you have 7 days to return legally for any reason
