I'm sure no one on here will know the definitive answer, but I wanted opinions before I go ape at a company.

Basically my wife ordered a £120 item online 5 weeks ago and subsequently returned it via recorded delivery 4 weeks ago for a refund.

3 weeks ago there was no sign of our refund, so we tracked the delivery of the item online (Royal Mail) - no one was in at the return address, so a card was put through their letter box - they claim to have not received it, so my wife messaged them with the tracking number so that they could either collect in person or arrange redelivery, neither of which was done.

Now, I'm stuck, as Royal Mail have our parcel and cannot attempt redelivery as the company left it too long (more than 18 days), so presumably the parcel will come back to us for us to resend it at our expense.

I just wondered:
1.) who is now responsible for the pursuing the parcel, us or the company?
2.) should the company refund us for repeated delivery charges incurred because they weren't in for the initial delivery and couldn't be arsed to arrange a redelivery?

How did you pay?

I had similar recently as opened case through paypal. Sent item back to seller same as you, but seller refused to sign for the broken item I was returning.
Sent tracking receipts to paypal, they refunded me and eventually courier gave me back broken item.

First things first - you have the right to a refund under Distance Selling Regs 2000 assuming the goods were unused and are re-saleable.

The return postage technically falls to the seller although most T&C which you have contractually entered in to will ask you to cover it.

Given that you have tried, I'd probably pursue the refund and ask the company to make their own arrangements to collect.

Either way, they must refund as is their legal obligation. Stinky law for sellers but its designed to give you the same legal rights as if you have inspected in person.

There are exemptions which you should ensure you are not foul of, ie. the item was personalised or otherwise specially prepared for you or that you yourself are using for business purposes.

Most shops will take it back and cover postage but that's not the law so don't confuse the two. But you are able to return and have done so in accordance with your responsibilities (within 14 days is the big one there).

I get it a lot with car parts, pain in the tits when people buy things they don't really want or need but the law is the law.

Thanks Generation and Ian, I think I'll contact PayPal as a matter of course to tick all the boxes.

...and no Ian, it wasn't clothes or personalised items (or a sex toy before anyone comments, haha). It's the type of item that the company will be used to having returned. It was unused and undamaged too.

Easy if it's paypal and you'll probably end up with both cash and items, if they want to be shits about it.

Usually find paypal kicks people into gear though

Alright, keep your hair on! It doesn't matter what the item is!

The issue now appears to be almost solved. Royal Mail will be returning the item to us, then the company are apparently going to pay for a courier to collect it from us.

I've got my Paypal dispute drafted though, just in case.
