there is a POTN advert which as a picture of the pipercross black mamba in it. I too this for pipercross and gave no one else permission to use it. I need to know what other mags (issues to) that this ad has appeared in.
I've got fast and modified march 2006. if you can have a look through any ones you've got and give me the details.

Pipercross have probably supplied this in good faith? Depends how you've licenced the pic, whether POTN are acting as an agent for Pipercross, and whether you have actually incurred a loss as a result of that advert being printed.

incurred loss because I was never paid by POTN for the use of my pic.they are using it to advertise a product they sell to make profit on. only pipercross where given permission to use it not another shop or company. thats the bit I'm unsure about.
I am a member of the NUJ so talking to them on monday.

pipercross will have given them the pic. the point is they are using it to advertise a product to which they are getting paid for. the other pics were taken by pipercross but that one was taken by me. why I am bothered is because it is loss of income for me.

Well no its not , If pipercross gave them the pic then thats there choice , you charged pipercross , they paid you , you have received your income.
You sold the picture to pipercross so they can do what they want with it.
They could give it to me i could take a big sizziling poo on it and advertis it and you cannot do anything about it.

it does not work like that nath. I only gave pieprcross permission to use it for their own advertisment. I never said they could give it to shos that sell pipercross products to advertise. I never sold the picture to pipercross. They have limited right to use it. They don't own the copyright.

unless you have got something in writing and signed by pipercross that they are only soley allowed to use it then you havent a leg to stand on.
You may also lose any potential work from pipercross for being difficult about this picture.

works the other way around matg, the onus is on pipercross to get something signed to say they can use it to do what they like with it

but then i took a picture of my old corsa and fastforward gave it to max power to print in ther ad every week, spose i had a case there too
