This lad (ThomasFra1n) on my local cruise forum got accused of hacking someones MSN account, so he got a bit of stick of people. Now this has appeared on the site Bit of an essay. I dont have a clue if its someone bullshitting or not?

[quote name='TheWebMixer']
Hello, it has become apparant certain allegations have been made against a user on this site known as "ThomasFra1n" as in the terms and conditions of your web host "http://www.cwcs.co.uk/" Slander has been placed against this user which is unlawful, as well as abuse and liable that has been placed against this user verbal and in text format you are liable for this as it is stored on your server(aimed at the admin of http://www.cruisewestcumbria.co.uk/).

"General Conduct
Clients are prohibited from transmitting on or through any of CWCS' services, any material that is, in CWCS' sole discretion, unlawful, obscene, threatening, abusive, libellous, or encourages conduct that would constitute a criminal offence, give rise to civil liability, or otherwise violate any local, state, national or international law.

CWCS' services may only be used for lawful purposes. Transmission, distribution, or storage of any information, data or material in violation of UK law, or by the common law, is prohibited. This includes, but is not limited to, material protected by copyright, trademark, trade secret, infringement of copyright or trademark, misappropriation of trade secrets, wire fraud, invasion of privacy, pornography, obscenity, defamation or any other statute. CWCS' reserves the right to remove such illegal material from its servers.

The client is responsible for keeping their billing data with CWCS up-to-date and accurate. Furnishing false data on any contract or application, including fraudulent use of credit card numbers, is grounds for immediate termination, and may subject the offender to civil or criminal liability.

The resale of CWCS' products and services is not permitted, unless specifically permitted and documented in a written agreement.

Important IP Disclosure: CompuWeb Communications Services Limited Internet may assign client a reasonable amount of IP addresses (Internet Protocol) on a temporary basis or for the life of the contract. Client agrees that IP addresses are not portable and acknowledges that IP addresses are the sole property of CompuWeb Communications Services Limited and are assigned as part of the services. Furthermore, client acknowledges that use of IP addresses not allocated by CompuWeb Communications Services Limited to client or users is expressively prohibited and will incur a penalty fee. This fee would be calculated on a standard engineer’s hourly rate fee of £100 separate from any other service or incident fees prepaid by client."

I suggest you remove any content that has been placed against this user along with allegations, as I have checked this users computer myself and they have never has "IceColdReloaded.exe" Stored, saved or installed on there computer, if you do not remove the content you are in clear violation of your hosting "Terms & Conditions" and UK Law.

If your account is locked out it may be for another reason such as you typed your password incorrectly more the 3 times to contact MSN about this problem Contact at "http://HelpDesk.msn.com" and they will help you fully in any matters with your .NET passport. as you may also be aware .NET passports are hackable just as anything else that can be accessed on the internet through different "protocols" but there are different steps you can take to protect yourself such as Installing a firewall, virus Checking Downloaded Files, Making sure you use official websites, if you are unsure about anything online don’t do it!!, again if you suspect your .NET Passport has been hacked go to "http://HelpDesk.msn.com" and you will be assisted by a nice member of MSNs Support Staff.

To People would like information on hacking such as the Moderators on this site "Lol" tools such as Sub7 are illegal, and so is any unauthorised access to data, unauthorised change to data, denying access and storing peoples data without consent or the authority to do this.(only morons hack, it the most stupid traceable crime)

To Users of ice cold reloaded you may not be aware of this but this is a well documented program, it will key log and send everything you type to the creator’s server hence key logging you, and anything you type on your computer they will have. Just a warning for people who do attempt to use this.

I hope you remove the accusations from your forum.

Thanks for reading.

This wouldn't be posted on the board - it would be written direct to the host. There's adequate information available, there's a postal address in the domain WHOIS, so its not as if they've no ability to contact in this way.

The rest is copied from some policy somewhere and mostly unrelated, paying for the site with a fraudulent credit card or the nature of being assigned an IP addres is bugger all to do with policy on slander.

Also people of legal background don't check computers themselves, nor would anyone without a lot of time and effort be able to tell that that .exe had never been there.

They also certainly don't offer advice on technical matters such as what's going on with the MSN account.

No official complaint appears to exist, and as this one is clearly aimed at scaring you rather than being reasonable, I would tell him on this occasion to do one.

Then I would make sure you're not breaking the law anywhere and act if you need to, but thats because you should be anyway.

Slander is actually illegal but the person slandered usually needs to prove damage or loss, which is not clear here.

You also have an obligation to act upon what you are aware of it and it would harm your defence if you fail to do this.

Basically don't leave yourself open to it, but also don't take any of that wannabelegal crap too seriously.
