is this fraud?
Some guy bought my car off Ebay, he now says that because it on finance he wants the car first then he will clear finance. i said the terms of the sale was cash on collection. He said i can report you for fraud...
Shall i report a non payer to Ebay??

yes its fraud
but if you repay the rest of the balance off straight away i think its ok

well that was my intention, sell car and pay off finance. Surely thats the only way most people can sell a car..

I sold a car that still had finance on it years ago.
Got the balance off the finance company. Got the buyer to write a cheque for the outstanding balance addressed to the finance company and the cash difference to myself. Worked fine.

I would say him, he new it had finance and that i wanted cash on delivery

I don't think there is a problem if both buyer and seller know what to do in terms of clearing the finance when money exchanges hands.
The only reason HPI and other such companies provide the finance check, is so that people don't sell the car without letting the buyer/new owner know.
I could be totally wrong about that though
