driving to work this morning and saw a learner drive obviously sat with someone else on the road. What would happen if a learner driver who was fully legit and insured on their car was driving on the road but the person they were sat with was above the legal alcohol limit? if the police pulled them over and found the person sat with the learner was over the limit would they be charged? would the learner be charged? what if the learner did not know how much alcohol they had consumed?

iirc the learner and the person instructing get charged as they are both technically in charge of a motor vehicle

The 'instructor' is in charge of the vehicle and they get charged.. This happened to two mates, the guy who was over 21 decided it would be a good way to get a lift to the pub! Bloke driving had a larger and the guy 'in charge' had about 8 pints..
Police pulled them as they left the pub and breathalised them both.. Driver got nothing, passenger got 10 points.
