Just reading a thread on another forum about buying a car miles away and driving it home on the pretence of having booked an MOT locally.

Some debate going on and no clear answers but found some history on it -

Secretary of State for Transport V. Richards ( 1998 ) JP 682 Queen's Bench Division, guy stopped for cigs and was reported for no road tax.

quote:
On the facts of this case, it is ridiculous if a driver could not stop to obtain petrol on the way. It would fly in the face of common sense if some short stop cannot be made by the driver, for whatever purpose, providing he is on his way to the test station.

Also this one although no title for it -

quote:
Another case involved driving a car 40 or so miles past a number of test places to an MOT centre that had specialist knowledge of ancient Rolls Royce cars. Not guilty as we accepted his explanation that testing early Rolls Royce motor cars required expertise not available at the other MOT stations.

Neither constitutes much of a defence for driving a regular car past MOT stations which are closer, but there are some cases where people have driven other than directly to and from the closest station.

Does the law saying you can only drive it to the test station say it has to be the nearest one?

I would double check the "not insured" point... They cant not insure you for no MOT

It would of been a very long time ago when the police didnt have an insurance database and didnt ring up companies to check if you had a policy in place and kept the certificate

My mate rolled his car and was issued a £60 fine for no MOT, and got full payout for it as well.

No other cars involved, late at night.

Been driving mine the last 6 weeks with no MOT. Got it booked for next week. Had no trouble off the filth, but I've also never been pulled over driving in the last 4 years

I was more interested in the legality of driving a longer distance to get a test, also would mean you don't need tax.

if the insurer cancel the policy but you dont sign the documents thry send you then they'll have to pay out.
with regards to mot invalidating the policy, the only way they could do that would be due to the vehicle being unroadworthy and that being a cause of the accident. but that can apply to cars that have an mot as well

Question is whether anyone has been done for driving without tax, having booked an MOT miles away and used the no tax no MOT exemption to drive on the road.

I'm sure it's not possible but I also can't find any previous convictions for it.

I too looked into this, car was 50 miles from home. Booked into a local garage near my area but would have driven past multiple MOT test stations. I didnt risk it in the end, cost about £60 to get it transported which was less than the fuel and a possible fine

Regarding the insurance question if you crash on the way to a test centre the insurance will go up for a debating and may fall in your faver or agenst u it is a 50 50 case a lot of underwriters would class u as uninsured as insurance tell u to buy a car with tax and test

And as for having a COI ( certificate of insurance ) If you cancel ya insurance and still have the COI and crash the insurance company will not honer the crash but can prosecute u under the road traffic act as its a legal requirement u sent it back and if ya don't ya can face a fine ext ext I only know this as I use to work for insurance dealing with car van home and contents hope that clears everything insurance wise

Apart from the fact you need the MOT to tax it?

Slightly related but I know someone who was delivering a vehicle on trade plates as it had no tax, he stopped to answer his phone and got done by the police.
