Problem is, as has been mentioned, the burden of proof is much higher in court. So he could in theory be cleared, even with more evidence against him than in the Suarez case, and the FA could then wash their hands of it. And if that happens it would be the perfect outcome for him, as he (and the FA) avoids going through the FA's own system without the police charge, where the case for a guilty charge would be stronger.
