Hey guys/gals, got a little bit of a work situation going on atm and would like your opinions please

I work nights and so I sleep during the day - usually between 9am and 5pm

Today I got a phone call from this stupid girl at work (who EVERYONE already hates) at 1:30pm - After she took over from me at 7am, so she'd know I'd be asleep by then

*Phone Rings*
Me: Hello (in a half asleep voice)
Girl: Hi its (name)
Me: Are you seriously ringing me at 1:30pm?
Girl: Oh were you asleep?
Me: It's 1:30pm, what the fuck d'you think?
*I hang up*

Now shes told the manager that I swore at her and shes put it in writing to take it further...

My question: Since this was outside of work can this be taken further? Well, she phoned me from work, but obviously I was at home. Also, if she can, couldn't I just deny ever swearing at her?

Just deny it and there's no evidence at all. I've done it a few times at work and even when they complained officially about it and got suspended for ages, i was told that it was just hearsay and there was nothing that could be done about it.

Admitting it would definetly be a bad idea.

i got a bollocking for doing the same, I swore at the managing director, bit of grovelling and it was cool though. just tell them that she knows your shift patterns so you would be asleep and she obviously knew it. tell them youre cranky after a hard nights work and your she wouldnt appreciate a phone call at 2am when shes in work so early.

on another note, shes a cunt for doing it, and a bigger cunt for grassing. arselicking bitch

Great, thats what I thought, the annoying thing is, shes going to be taking over from me again at 7am (I'm at work right now), and this is a girl I've already fallen out with a couple of times in the past... I just know its going to end in a big argument....

I would own up to it, explain why you did it.

Yeah, I see your point, but thats just going to end in my manager saying something like 'swearing should never happen, you're in the wrong.'

Plus everyone gets called outside of work from time to time, like if someone calls in sick and they need cover.

id admit it and point out the fact it had fuck all(those words exactly) to do with work as you werent actually at work. like when i asked a colleague to 'come for a walk offsite' a few weeks ago to discuss our conversation further.....he declined!

Even if you may get called out of work hours you still don't have to answer? It's your own time. Say what you want to whoever. Nothing they can do about it as far as I'm aware.
