I sold a phone on gumtree about a week ago, it was a samsung galaxy s3 and it sold for £380..

A lady called up(of english origin) asking to buy the phone but she lived in london so said would I mind posting the phone at her cost.

I agreed and said no problem aslong as she paid via bacs...

She did and within the hour I had the money in my account.

Yesterday my bank account was frozen and the £380 has been taken by the fraud squad who are looking into it as they don't think it was a legitimate transaction..

Am I fucked here? Or will I be likely to get my money back?

Seems odd as I know my bank is a right mission for me to process a bacs transfer so surely quite hard to fraud?? Worries me if someone paid me for a car etc via bacs and drove off when cleared if something like this could happen.

send them evidence of the sale and they'll return the money to you.

what would happen if they had paid from a stolen account, fazza will be the innocent party here (and the correct account holder) but surely the bank should protect fazza from fraud as well as the original account holder?

£380 for a brand new still sealed simfree galaxy s3 is cheap. It also came from my shop, and is much cheaper than you will buy anywhere else new

I'd be doing it already, you don't get your bank account frozen for nothing.

Sounds like account has been victim to account take over fraud..

Bought loads of items rather than have to withdraw physical cash, create a paper trail..

Bank are probably checking you didn't take over other account and transfer money to yourself

Get a few in each week Stuart, drop me a u2u if you want one.

Finally got hold of the customer we sent this one to, her son had binned the royal mail delivery card so she thought we hadnt sent her anything and thought she had been scammed.

rather than calling us(knowing full well we were a business) she went to her bank and said we had fraudulently taken her money

Apparently we will have the money back into our account today

If you look at other shops such as carphone, p4u etc you will find its much cheaper

Perhaps not much cheaper than someone else taking out a contract then flogging it on ebay etc

Ah right, compared to high street stores it will be much cheaper.

But the likes of internet/ebay stores etc, its not....
e.g. http://www.ebay.co.uk/itm/NEW-SAMSUNG-GALAXY-S3-I9300-BLUE-16GB-UNLOCKED-MOBILE-PHONE-LATEST-2012-MODEL-/140873609546?pt=UK_Mobile_Phones&hash=item20ccb8b14a

Not having a dig btw, just pointing out about other internet deals that are better.
