What a morning, was in transit going up to see my folks this morning, up a very steep hill which was snowy . My van wouldn't get up so I stopped. A gentleman stopped in a discovery and offered to tow me up which I accepted. So he pulled in front of me and put the rope on . As he gets in an a3 come down the hill at at least 40mph sliding on snow sideways and hit the guy towing me, who went back and bumped my van . His motor was fucked, Audi totally fucked , my van has done front panel bumper and cross member.
So it's now insurance , who claims off who? If it means I have to claim off the guy who was helping me then I will repair and pay for it myself as he was doing a kind deed. The Audi driver was a nob, didn't once say sorry . Infact if his kids wasn't with him he was going right way for a slap.
Me and land rover was stationary. He come to our side of road .
Van will cost me roughly £300 to put right, I don't mind paying it to make land rovers life easier. Not injured and neither is my child and it was all an accident . I presume normally I would claim off land rover and he would claim all lot off Audi. If this was case would it be detromental in any way to land rover owner?

i think he would claim off you. You didn't leave adequate space behind i know he was towing you etc but it may go 50/50

If the audi driver admits fault then I believe you both claim off him.
His actions resulted in your vehicle being damaged.
Didn't leave adequate space i'll remember that next time someone hits me in a car park.

prove negligence. i think you'll find the audi drivers insurer deny liability as technically its not his fault.

He was doing at least 40mph, enough to knock a 3ton disco 6ft back, we was stationary , Audi driver also come onto our side of road. Impossible to get out of it

Claim off me? I was end of a chain, I didn't hit anyone . Audi hit land rover and landrover hit me. Also 6ft is adequate especially seen as we wasn't moving

your insurer was shit then. no proof and it cant be used against you, same as anything else. the other guy could say you were stood on the roof controlling the car with rope, doesnt make it true

In a case like this id have taken pictures of where the audi driver started sliding at 40 and where he ended up. Show the insurers the distance he went sideways etc and what side of the road he was on, going by the tracks.
Without pics i cant see them getting their head around why anyone would do 40mph down a steep hill covered in snow.

I don't think he was intending to do that speed, his wheels was locked up and he gained speed. I have spoke to landrover guy and am going to go see him tomorrow

If it had of been twenty seconds earlier the landrover guy was crowched behind his motor attaching rope. He would of been killed

both you and the land rover simply say you were both stationary and out of your vehicles parked and the audi came and hit you both, he won't have a leg to stand on

don't even bother saying to the insurance company about the speed you think the audi driver was doing. they won't even care, unless you're a car crash investigator with accurate reading equipment.
if you do, it makes you as bad as the old people who hear a loud exhaust and immediately assume someone is doing twice the speed limit, despite still being in 1st gear.
