my mates put my number down when hes applied for a payday loan, they keep ringing and texting me because hes not paying it and wont call them because hes obviously not paying them.

ive rang them saying im not him and have no dealing with them but theyve said they wont take my number off until theyve spoke to him. who do i need to be looking into contacting or threatening them with so they'll leave me the fuck alone??

it's not hard for someone to put someone elses number on an application form, tom. i always give random numbers to stop them ringing me constantly.

Lee, can I just say that a good proportion of your threads are for or about mates. Cheers.

Next time they ring inform them that each phone call thereafter will be charged at £100 then send them an invoice once a week.

Might try this. Take out premium rate number that's £1000 a minute to call. Run up debt with payday loan company. Wait for them to ring. Profit

Administration of Justice Act 1970 Section 40 perhaps, something to do with harrassing you for payment when you don't owe money. Can't remember the wording but that might be an option.

Information Commission also might be interested being that the record is not correct and they are not willing to rectify. Remind them there's a principle 4 breach and its their obligation to maintain accuracy. Offer to supply the correction on durable media (email is fine) and remind them that as soon as you do so, you'll have a complete complaint to make against them to the ICO.

Or put it on speakerphone and go about your day. I'd probably favour the latter, the cubicle nobhead you talk to isn't going to care what legal leverage you have at your disposal.

Would you not need to warn them that calls are charged as companies have to do for us?

I'd bet that the diallers won't dial anything that's not a standard rate call.

Next time just put your phone next to the radio or something and tell them to hold the line whilst you locate your mate. Let them hang up.

You're a better mate than he is, that's for sure
