My mate bought a laptop from a shop 2nd hand which is a few month old . He got it for an Xmas present for his brother .

He said it's getting hot and cutting out . He took it to shop and they said it hasn't done it and it needs sending off and it will be 14 working days .Obviously this is no good . They are refusing a refund . He bought it 3 days ago .

What are his rights ? Sale of goods act etc . Does anyone know

What second hand shop was it? The likes of cash converters offer a warranty

When I worked for cash converters, it was policy to send the item to our repair team and if they can repair it they will and if they can't then a refund/replacement will be offered.

14 days to take the item back in the original condition and get a full refund I thought. Get him to give citizens advice or trading standards a shout

I beleive the shop has a right to try and repair it, but as the goods where sold faulty it should easily be refundable.

Not sure how this applies to second hand goods though

It was cash convertors I think . They offered a full credit note or repair. I think there was an argument as it's for an Xmas present and it takes 14 days . The manager left it plugged in half hour and said there is nothing wrong with it.

Second hand goods is a bit of a grey area when it comes to Sales of Goods act. The company have to offer a remedy to the situation and this can be a repair, replacement or a refund and most will do it in that order.

How did he pay for it? If it was with a credit card he should start a claim through his provider.

Failing that try vacuuming the cooling vents, its probably clogged up with dust and debris, very common on laptops.

He paid cash . Surely them offering the full amount in credit vouchers is admitting liability.

They have to be given the opportunity to rectify, which they are.

Christmas present thing doesn't change anything.

I'm not sure that they have to rectify if within 14days. If it's faulty you can return it for money back. It's the only circumstance that you can 100% return something even if the shop say you can't.

The issue is whether its faulty though, the shop are claiming it isn't.
