Gents...
Mate has just p/ex (to a dealer) his focus RS against an astra VXR. RS was financed, so he has done all the paperwork and transferred finance etc..
Guy drove the VXR 300 miles to my mate and has driven off in the RS. Dealer has done like 30 miles and its blown up (his words).
Where does my mate stand? Car was immaculate with no issues when he sold it.
They are saying he wants the RS recovered to my mate and he will take the VXR away.

If he inspected the car prior to taking it away then it's sold as seen. he isn't a dealer with guarantee's at the end of the day and if it was the other way round you have to think of the book dealers pull out with all the excuses under the sun to get out of having a fucked car back.

That was my advice to my mate. It's his car now. Why is he calling you?
They have recovered it and he was told. We will let the finance company decide.
Mate says he was told he was doing 70 and pulled into the fast lane to overtake. His bet is as it's got a short shift kit and gears are very close. The guy has gone from 6th to 3rd instead of 5th to boot it.

I still wouldn't expect a petrol car to over-rev at 70 in 3rd, so I'd suggest he was going a little quicker than that!

If it was a private buyer he would have an extremely remote chance of compensation but as its a dealer he has nadda!
Just to clarify, was the log bog signed over into trade (yellow slip) or filled out as a new keeper?

I would say a private buyer would have zero chance too. The only cover they get is if it was sold with an undisclosed known issue. Which doesn't seem to be the case here, and near impossible to prove too

Its a Civil dispute, same with any transaction between two private people.. You can take someone to court for anything if you've got enough money.
