if i tax a car online today, obviously due to run out on the 31st jan
and the tax disc takes 5 working days to get to me, (Feb 4/5th)
Will the car legally be taxed for the first 5 days even if no / the old tax disc is displayed?

Yes
The dvla database is automatically updated so cameras and cops that pick your plate up will see the car as taxed.
id advise printing out the conformation sheet and keeping it in your glovebox untill the disc arrives and if parking on streets with metres remove old disc from window.. (from previous experiance with traffic warden, once saw letter was all ok)
